Technology is critical to the remote online notarization and witnessing of documents.
That is why it is important to establish a relationship with a RON Service Provider that will provide the necessary technology in order to satisfy all rules and regulation requirements under Part II of Chapter 117, Florida Statutes.
The following standards shall apply to any online notarization performed by an online notary public or his or her RON service provider in the state of Florida:
Audio-video communication technology
1. The signal must be secure from interception, access, or viewing by anyone other than the participants communicating.
2. The technology must provide sufficient audio clarity and video resolution to enable the notary to communicate with the principal and any witness, and to confirm the identity of the principal and any witness.
A RON service provider has to satisfy tamper-evident technology requirements by use of technology that renders any subsequent change or modification to the electronic record evident.
The online notary public may not allow another person to use the online notary public’s electronic journal, electronic signature, or electronic seal, other than a RON service provider or other authorized person providing services to an online notary public to facilitate online notarizations. An online notary must notify an appropriate law enforcement agency and the Department of State of any unauthorized use of or compromise to the security of the e-journal, e-signature, or e-seal within 7 days after discovery of such unauthorized use or compromise to security.
